Terms & Conditions
As we can accept your order and make a legally enforceable agreement without further reference to you, you must read these terms and conditions to make sure that they contain all that you want and nothing that you are not happy with. This remittance services agreement ("agreement") sets forth the terms and conditions under which Simple Transfer will provide its remittance and related services to you.
Application
  1. These Terms and Conditions will apply to the purchase of the services and goods by you (the Customer or you). We are FAST TRACK MONEY TRANSFER LIMITED whose trading name is ‘Simple Transfer’ https://www.simpletransfer.co.uk (hereafter referred to as ‘Simple Transfer’ or simpletransfer.co.uk) a company registered in England and Wales under number 06872129 whose registered office is at City Reach 7th Floor, 5 Greenwich View Place, Millharbour, London, E14 9NN with email address support@simpletransfer.co.uk; telephone number 0203 570 8090; (the Supplier or us or we).
  2. These are the terms on which we sell all Services to you. Before placing an order on the Website, you will be asked to agree to these Terms and Conditions by clicking on the button marked 'I Accept'. If you do not click on the button, you will not be able to complete your Order. You can only use our services if you are eligible to enter into a contract and are at least 18 years old.
Interpretation
  1. Consumer means an individual acting for purposes which are wholly or mainly outside his or her trade, business, craft or profession;
  2. Contract means the legally-binding agreement between you and us for the supply of the Services;
  3. Order means the Customer's order for the transfer of funds or remittances of funds as submitted following the step by step process set out on the Website;
  4. Privacy Policy means the terms which set out how we will deal with confidential and personal information received from you via the Website;
  5. Services means the services advertised on the website, mobile application;
  6. Website means our website simpletransfer.co.uk or any of its subdomains e.g. https://web.simpletransfer.co.uk on which the Services are advertised.
  7. Beneficiary means the person to whom you have given us details to settle/send money on your behalf.
  8. Payment Account means the debit or prepaid card account or bank account (or such other source of funds that Simple Transfer agrees to accept from time to time for use hereunder and that you authorise Simple Transfer to charge) that you provide to Simple Transfer for Simple Transfer to charge for payment for your use of the Application. The Payment Account must be issued or held in your name at a depository institution in your country.
  9. Remittance the transfer of funds that you request and authorise Simple Transfer to process through the Application for payment to your Beneficiary
Services
  1. This Agreement applies only to the Remittances that you request through the web.simpletransfer.co.uk or www.simpletransfer.co.uk or simpletransfer.co.uk and any other associated mobile applications.
  2. In the case of Services made to your special requirements, it is your responsibility to ensure that any information or specification you provide is accurate.
  3. All Services which appear on the Website are subject to compliance checks. Our service may be delayed extensively due to stringent compliance process and policies. We are not responsible for any delay is settling funds to beneficiary which is caused due to any compliance query raised by our compliance team or otherwise delay cause due to settlement partner’s compliance process.
  4. We can make changes to the Services which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.
Registration Information
  1. In order to use the simpletransfer.co.uk website, you must be at least 18 years old, be a resident of the United Kingdom, or another origination country approved by Simple Transfer, have a Payment Account in your name in the approved origination country, and be registered with Simple Transfer. In order to register, you must provide us with information about yourself, such as your name, address, date of birth, telephone number, email address and other information or documentation that will allow us to verify your identity. The address that you provide when registering must be the same as the billing address for your debit card or prepaid card. You agree to provide complete and accurate information and/or documentation in connection with the registration process and you further agree to update this information as may be reasonable or necessary to keep it complete and accurate at all times.
  2. Your use of the website is subject to our ability to verify your identity. You authorise simpletransfer.co.uk to obtain information about you from third parties (including financial institutions and credit reporting agencies), although simpletransfer.co.uk has no obligation to do so. If you do not provide accurate and complete information during registration or when requesting a Remittance, we have the right to prohibit you from using the Service or to stop your requested Remittance. Inaccurate and/or incomplete information provided by you during registration or when requesting a Remittance may cause errors in your requested Remittance or may delay or restrict your access to the Application or the Service.
  3. Each time you access the simpletransfer.co.uk, website for remittance via login details, you shall be deemed to have confirmed the accuracy and completeness of all of your registration information.
  4. Your registration is personal to you. You should not allow your registration details to be used by anyone else. Registration with simpletransfer.co.uk allows your Payment Account to be accessed through the Application. If you lose your phone or believe your access to the Application has been compromised, you should contact simpletransfer.co.uk immediately at customerservice@simpletransfer.co.uk to change your password or disable your access to the Application.
Customer responsibilities
  1. You must not use our services to send funds on behalf of a third party.
  2. You must have a legitimate reason for sending funds to the beneficiary.
  3. You must use your own card or pay from your own bank account to pay for the services. We shall refuse to provide service unless payment has been received from the account or paid using the card of the sender (you) of the transaction.
  4. You must co-operate with us in all matters relating to the Services, provide us and our authorised employees and representatives with all information required to perform the Service.
  5. You must respond to any compliance query within 24 hours of query being raised by our compliance department.
  6. Failure to comply with the above is a Customer default which entitles us to suspend performance of the Services until you remedy it or if you fail to remedy it following our request, we can terminate the Contract with immediate effect on written notice to you.
  7. We reserve the right to withold your funds if we have reason to suspect that the funds received by us is proceeds of crime or otherwise not legitimately owned by you.
  8. We reserve the right to confiscate funds received and report to National Crime Agency if you attempt to fraud or use fraudulent ID or commit ID theft or use our services to launder money in any other way.
Personal information and Registration
  1. When registering to use the Website you must set up a username and password. You remain responsible for all actions taken under the chosen username and password and undertake not to disclose your username and password to anyone else and keep them secret.
  2. We retain and use all information strictly under the Privacy Policy.
  3. We may contact you by using e-mail or other electronic communication methods and by pre-paid post and you expressly agree to this.
Information we provide before the transaction is complete
  1. If funds are sent via a recipient form, before your transaction is complete you will be provided with the following information:
    • ● The amount the beneficiary will receive,
    • ● The maximum total Fee that you will be charged,
    • ● An indication of the exchange rate that we will apply to your transaction,
    • ● The location and documentation needed from the Recipient in order to collect the money (in case of cash collection),
  2. An estimation of time it will take for the funds to be made available to the recipient.
  3. If funds are sent via a mobile phone number, before your transaction is complete your will be provided with the following information:
    • ● The amount the beneficiary will receive,
    • ● The maximum total Fee that you will be charged,
    • ● An exchange rate that we will apply to your transaction. This will remain valid for 48 hours from the moment you complete the transaction.
Basis of Transfer
  1. When a remittance has been submitted on the Website, we can reject it for any reason, although we will try to tell you the reason without delay.
  2. The remittance process is set out on the Website. Each step allows you to check and amend any errors before submitting the request or order. It is your responsibility to check that you have used the remittance process correctly.
  3. It is your responsibility to ensure that beneficiary details are complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the Order placed by you through the website or mobile application.
  4. Information provided after we process a transaction After we process your transaction to the Recipient an e-mail will be sent to you with the following information:
    • a. A transaction reference number,
    • b. A confirmation of the exact amount we are sending to the Recipient on your behalf in both pay in and pay out currencies,
    • c. A confirmation of the Fee that has been charged,
    • d. An exchange rate applied to your transaction,
    • e. A location and documentation needed from the recipient in order to collect the money (in case of cash collection option),
    • f. A confirmation of the bank to which the money has been sent (in case of bank deposit option),
    • g. An estimated time when the money will be available to the Recipient.
  5. Any quotation or estimate of Fees (as defined below) is valid for a maximum period of 1 day from its date, unless we expressly withdraw it at an earlier time.
  6. No variation of the Contract, whether about description of the Services, Fees or otherwise, can be made after it has been entered into unless the variation is agreed by the Customer and the Supplier in writing.
  7. We intend that these Terms and Conditions apply only to a Contract entered into by you as a Consumer. If this is not the case, you must tell us, so that we can provide you with a different contract with terms which are more appropriate for you and which might, in some respects, be better for you, eg by giving you rights as a business.
Fees and Payment
  1. The fees (Fees) for the Services, (if not included in the Fees) and any additional or other charges is that set out on the Website at the date we accept the Order for transfer or such other price as we may agree in writing. Prices for Services may be calculated on a fixed price or on a standard daily rate basis.
  2. You must pay by submitting your credit or debit card details with your Order and we can take payment immediately or otherwise before delivery of the Services via the website at www.simpletransfer.co.uk.
  3. If you pay by bank wire, please note full cleared funds must be received by us from you in our account for us to authorise the transaction for payment to the beneficiary. If payment is not received within 24 hours of initiating a transaction, the transaction may be cancelled by us without any further notice. Failure to provide you notice of cancellation upon expiry of 24 hours will not impair our right to cancel it any time later.
Remittance Time Periods
  1. We will remit funds, to the Delivery Location by the time or within the agreed period or, failing any agreement: and
  2. If for any reason there is a delay for sending the funds to beneficiary, we shall not be responsible for any loss or damages, direct or indirect howsoever caused.
  3. If a money transfer you ordered is delayed or fails, you may have a right to receive a refund or compensation under Money Transfer Regulations. Please contact us at support@simpletransfer.co.uk for more information regarding refunds and compensations.
  4. Claims for refund or compensation must be supported by all available evidence.
  5. If you or your nominee fail, through no fault of ours, to take delivery of the Services at the Delivery Location, we may charge the reasonable costs of storing and redelivering them.
  6. The remittance of funds will become your responsibility from the completion of delivery or Customer collection. You must, if reasonably practicable, examine the remittance of funds before accepting them.
Risk and Title
  1. Risk of damage to, or loss of, any Goods will pass to you when the remittance of funds are delivered to the beneficiary, you or your agent.
  2. You do not own the remittance of funds until we have received payment in full. If full payment is overdue or a step occurs towards your bankruptcy, we can choose, by notice to cancel any delivery and end any right to use the remittance of funds still owned by you, in which case you must return them or allow us to collect them.
Withdrawal and cancellation
  1. You can withdraw the Order by telling us before the Contract is made, if you simply wish to change your mind and without giving us a reason, and without incurring any liability.
Right to cancel
  1. Subject as stated in these Terms and Conditions, you can cancel this contract prior to the funds released for payment to the beneficiary.
  2. The cancellation period will expire as soon as beneficiary has collected the funds or funds have been authorised or sent towards the account of the beneficiary.
  3. To exercise the right to cancel, you must inform us of your decision to cancel this Contract by a clear statement setting out your decision (eg a letter sent by post, fax or email).
  4. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
Timing of reimbursement:
  1. If we have not offered to collect the remittance of funds by the beneficiary, we will make the reimbursement without undue delay, and not later than:
    • a. (if earlier) 14 days after the day you provide evidence that you have sent back the remittance of funds.
  2. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
Conformity and Guarantee
  1. We will supply the Services with reasonable skill and care.
  2. We will immediately, or within a reasonable time, give you the benefit of the free guarantee for of the remittance of funds. This guarantee will take effect at the time the remittance of funds are delivered to us by you, and will not reduce your legal rights.
  3. We will provide the following after-sales service: Excellent Customer Service and After Transaction Care Transparent online information.
Duration, termination and suspension
  1. The Contract continues as long as it takes us to perform the remittance of funds.
  2. Either you or we may terminate the Contract or suspend the Services at any time by a written notice of termination or suspension to the other if that other:
    • a. commits a serious breach, or series of breaches resulting in a serious breach, of the Contract and the breach either cannot be fixed or is not fixed within 30 days of the written notice; or
    • b. is subject to any step towards its bankruptcy or liquidation.
  3. On termination of the Contract for any reason, any of our respective remaining rights and liabilities will not be affected.
Successors and our sub-contractors
  1. Neither party can transfer the benefit of this Contract to someone else, and will remain liable to the other for its obligations under the Contract. The Supplier will be liable for the acts of any sub-contractors who it chooses to help perform its duties.
Circumstances beyond the control of either party
  1. In the event of any failure by a party because of something beyond its reasonable control:
    • a. the party will advise the other party as soon as reasonably practicable; and
    • b. the party's obligations will be suspended so far as is reasonable, provided that that party will act reasonably, and the party will not be liable for any failure which it could not reasonably avoid, but this will not affect the Customer's above rights relating to delivery (and the right to cancel below).
Privacy
  1. Your privacy is critical to us. We respect your privacy and comply with the General Data Protection Regulation with regard to your personal information.
  2. These Terms and Conditions should be read alongside, and are in addition to our policies, including our privacy policy (http://simpletransfer.co.uk/PrivacyPolicy.aspx) and cookies policy (http://simpletransfer.co.uk/CookiesPolicy.aspx).
  3. For the purposes of these Terms and Conditions:
    • a. 'Data Protection Laws' means any applicable law relating to the processing of Personal Data, including, but not limited to the Directive 95/46/EC (Data Protection Directive) or the GDPR.
    • b. 'GDPR' means the General Data Protection Regulation (EU) 2016/679.
    • c. 'Data Controller', 'Personal Data' and 'Processing' shall have the same meaning as in the GDPR.
  4. We are a Data Controller of the Personal Data we Process in providing the Services and Goods to you.
  5. Where you supply Personal Data to us so we can provide Services and Goods to you, and we Process that Personal Data in the course of providing the Services and Goods to you, we will comply with our obligations imposed by the Data Protection Laws:
    • a. before or at the time of collecting Personal Data, we will identify the purposes for which information is being collected;
    • b. we will only Process Personal Data for the purposes identified;
    • c. we will respect your rights in relation to your Personal Data; and
    • d. we will implement technical and organisational measures to ensure your Personal Data is secure.

Excluding liability
  1. Simple Transfer excludes ALL liabilities excluding that of: (i) any fraudulent act or omission; or (ii) death or personal injury caused by negligence or breach of the Supplier's other legal obligations. Specifically, we are NOT liable for (i) loss which was not reasonably foreseeable to both parties at the time when the Contract was made, or (ii) loss (eg loss of profit) to your business, trade, craft or profession which would not be suffered by a Consumer.
  2. It is an offence to remit business funds using our website.
Governing law, jurisdiction and complaints
  1. The Contract (including any non-contractual matters) is governed by the law of England and Wales.
  2. Disputes can be submitted to the jurisdiction of the courts of England and Wales or, where the Customer lives in Scotland or Northern Ireland, in the courts of respectively Scotland or Northern Ireland.
  3. We try to avoid any dispute, so we deal with complaints as follows: If a dispute occurs customers should contact us to find a solution. We will aim to respond with an appropriate solution within 5 days.
